Is Delta-8 THC Legal in Wisconsin? Delta 8 Legality by State 2023

Although marijuana is banned in Wisconsin, CBD retailers and others are leveraging the power of a legal gray area. This has allowed them to sell select, legal cannabis products. Delta 8, sometimes referred to as D8 THC, is a psychoactive compound that originates from the Cannabis Sativa plant. But is delta-8 THC legal in Wisconsin? Let’s find out.

There are two things that make delta-8 federally legal. If it’s isolated from hemp plants rather than marijuana plants, the federal government does not consider delta-8 THC to be illegal. However, the delta-8 must also be under 0.3% delta-9 THC content by dry weight. Although many states now permit the use of Delta 8, this is not the case everywhere.

You may legally buy, consume, sell, produce, and manufacture delta-8 THC in Wisconsin. That’s because state legislation is consistent with the federal 2018 Farm Bill. The Farm Bill legalizes hemp items as well as cannabinoids made from hemp.

According to WI Stat 94.55, any portion of the hemp plant, including thereof seeds along with derivatives, cannabinoids, extracts, isomers, isomers’ salts, salts, and acids, regardless of producing or not, accompanied by not over 3% concentration of Delta-9 is defined as legal hemp. 

Additionally, neither delta-8 nor any additional THC variation generated from hemp is specifically mentioned in section 961.14 of Wisconsin’s Uniform Controlled Substances Act. State law only restricts marijuana’s tetrahydrocannabinol.

It is against federal and state statutes for a business to distribute delta-8 goods made from marijuana with more than 0.3% THC. Marijuana is illegal at both the federal and state levels, including purchase, possession, and use.
