Is Delta-8 Legal In Rhode Island?

Delta-8 THC is illegal in Rhode Island.
With the passing of House Bill-5151, Rhode Island made hemp, hemp extracts, and products derived from hemp legal. Also, they approved the definition of “hemp” described in the Farm Bill in 2019. So, it stands to reason that Delta-8 and other hemp products would be legal as well.
However, later, the state’s legislators made some extended amendments to the list of Controlled Substances. As a result, according to the Federal Regulations of the state of Rhode Island, Title 21, R.I. Gen. Laws § 21-28-2.08, in which Delta-8 is defined under the state’s “THC” definition, delta-8 THC is classified as a Schedule I drug.
Although this act makes an exception for some types of hemp, it nevertheless outlaws anything with even trace amounts of THC that are for human or animal use. In addition, anything that is meant to efficiently deliver THC into the body system is illegal. According to this, Delta-8 has no accepted medical use, and possession of any quantity of it is illegal.
Buying Delta-8 in Rhode Island
You cannot order delta-8 THC in the state of Rhode Island. Even carrying a medical card for marijuana consumption won’t help you in this. Because Delta 8 is a Schedule I drug, you will not be able to buy it using your card. However, in neighboring states of Rhode Island, such as Massachusetts and Connecticut.
Future of Delta-8 THC in Rhode Island
THC products are often used for personal and therapeutic enjoyment, and Delta-8 has become quite popular nowadays. Aligning with the 2018 Farm Bill, it’s legal federally and in most states. But, still, several states like Rhode Island don’t allow any manufacturer, distribution, sale, or possession of Delta-8.
We think that delta 8 THC, like recreational marijuana, is bound for legalization on a national scale.
Final Thoughts
The state of Rhode Island has just decriminalized marijuana. Therefore, the present ban on delta-8 may change within the next year to two years. At least, let’s hope for the best!
