Delta-8 Tetrahydrocannabinol is no longer illegal in the state of New Mexico. According to hemp manufacturing legislation in NM, producing hemp in the state is lawful if it has a THC content of below 0.3%.

The cultivation of hemp and the sale of hemp seeds became lawful with the Agriculture Improvement Act of 2018.

As of a recent legislative change in New Mexico, Cannabidiol and all hemp products are now legal across the state following federal regulations. Hemp is defined by state law as “the Cannabis sativa plant and any portion of that plant, including kernels and any derivatives, elixir, cannabinoids, chemical compounds, acid, salts, as well as isomers’ salt, either growing or otherwise, with a concentration of delta-9- tetrahydrocannabinol below 3/10% on a dry – weight.”

Additionally, the state revised its Controlled Drugs and Substance Act. It now provides particular exception for items from hemp in areas where “tetrahydrocannabinol”  is a Schedule I drug.
