In a number of states where marijuana is illegal, Delta-8 is showing promise as a potential delta-9 THC replacement. Let’s dive into if delta-8 THC is legal in different states in the US. Today, we’ll be focusing on if delta-8 THC is legal in Mississippi.

What is Delta-8 THC

Delta-8 is a lawful isomer of CBD when derived from hemp. Because it comes from hemp (less than 0.3% Delta-9-THC by dry weight), it is legal in the United States.

Since Delta-8-THC is only minimally psychoactive, roughly 60% as potent as standard THC products, it surprises many customers. It may have therapeutic advantages in addition to its soothing recreational effects. That’s because our understanding is it interacts with our body similarly to Delta-9.

The historic Farm Bill legalized both delta-8 and hemp in the United States. The principal psychoactive component in cannabis is THC, and for a long time in the United States, the whole plant was unlawful regardless of whether or not it comprised any of this molecule.

In all 50 states, cannabis with less than.3% Delta-9 THC by dry weight is legally “hemp” under the definition of the Farm Bill. Marijuana still is a federally restricted drug according to the Drug Enforcement Administration’s Schedule 1 list if it contains more than.3% Delta-9 Tetrahydrocannabinol per dry weight. Given that cannabis with THC concentrations of 0.3 or higher is legal for medicinal or recreational use by adults in many places, this remains the case.

Local legislation in Mississippi, however, has limited manufacturing, possession, and use of this cannabinoid.

Mississippi is a select few states that deviate from federal delta 8 THC limits.

Although certain cannabinoids receive more liberal treatiment in Mississippi than others, the vast majority of cannabinoids generated from hemp are illegal in the state. Mississippi has a blanket prohibition on Delta 8 THC.

Delta-8 THC is ILLEGAL in Mississippi.

Hemp and hemp derivatives are not in the definition of “tetrahydrocannabinol” in House Bill 1547. Possession of fewer than 30 grams of cannabis has a minimum fine of $250 to $500; possession of more than 30 grams carries a fine of $1,000 along with one year in jail. A two-year jail sentence is the standard punishment for possessing hashish or hashish extracts.

Delta 8 THC is probably treated the same way as marijuana is in this state. However, it’s unknown what the exact consequences are for possession.

According to the strict local laws of Mississippi, Delta-8 THC is illegal here. Neither medicinal patients nor recreational users may purchase it.

Final Words

Although it is among the top states regarding raw hemp bio-mass production, Mississippi is a tad behind in its hemp policies.

Delta-8 THC is illegal in this state, and this prohibition is not expected to be overturned anytime soon. We may anticipate these archaic regulations to evolve as America develops and more states legalize cannabis.
