Is Delta-8 THC Legal In Arkansas? Updated Delta 8 Legality 2023

Delta-8 THC Laws in Arkansas 

Being the home to a progressing medical hemp program, Arkansas has made several cannabis preparations, including different CBD-products legal in the state. This Arkansas law-making aligns with the federal definitions of other hemp-friendly nation-states. 

According to the Industrial Hemp Act 2-15-401, any cannabis plant containing Delta-9 THC below 0.3% based on its dry weight and its other naturally-derived cannabinoids is hemp. Anyway, the state law makes several examples where cannabinoids, tetrahydrocannabinol, in particular, are not legal. 

To say more precisely, Arkansas legislation classifies the extraction and synthesis derived and Schedule-VI controlled THC substances preparations. This was the scenario till February 2021. 

A modified hemp bill was replaced by Arkansas legislators withdrawing the introductory provision that restricted Delta-8-THC earlier:

  • Additionally, any material classified in Schedule VI under § 5-64-214 by the Director of Health Department, any substance, mixture, preparation, or compound, produced either directly or indirectly from plant origin substance or separately through chemical synthesization or a chemical synthesis and extraction combination, in which includes any amount of the substances mentioned below or comprises any some of their isomers, salts, and isomers’ salts. At the same time, there is the possibility of the existence of isomers, salts, and isomer’s salts within the particular chemical designation, which is in Schedule-VI:
  • Hemp;
  • Tetrahydrocannabinol;
  • A synthetic corresponds of:

(i) The material comprised in the hemp plant

(ii) The substance included within the resinous extractions of the genus Cannabis 

 

House Bill 1640 makes D8 THC legal in March 2021. 

The purpose of this bill is to change the industrial cannabis production law, recall the industrial hemp act of Arkansas, in order to initiate the amended industrial production act for hemp. 

Though under the farm Bill 2018, Delta-8 THC is federally legal in the U.SEarlier cannabis was allowed for qualified medical users in Arkansas. However, different regions of the state went to the polls to make low-priority enforcement of anti-cannabis regulation. 

As of now, House Bill 1640 legalizes purchasing Delta-8 THC in the Arkansas state.
