Is Delta 8 THC Legal In Alabama? Delta-8 THC Legality By State 2023

Is Delta 8 THC Legal in : Alabama?

Let’s talk about if Delta 8 THC is legal in the great state of Alabama, also with updates from 2023. A phytocannabinoid derived from the cannabis sativa plant, Delta-8 THC is one of the numerous phytocannabinoids found in the cannabis plant. Other examples of phytocannabinoids are, of course, Delta 9 THC and CBD. For most people, hearing the word THC or cannabis implies a family of plants that include both marijuana and industrial hemp plant. The key difference between the two however is the Delta 9 THC content.

Thanks to the 2018 Farm Bill which made the distinction between hemp and cannabis is its Delta 9 THC content, hemp plants are cannabis plants that contain less than 0.3% Delta 9 THC by weight. This simple distinction is what separates the hemp plant from the marijuana plant and is also what makes several products including Delta 8 THC legal.

How Delta-8 THC Works

Because Delta-8 THC is a cannabinoid, it works by affecting the endocannabinoid system that is responsible for creating and receiving cannabinoids. This endocannabinoid system is a network of receptors within the central nervous system and the peripheral system and when stimulated these receptors affect numerous functions within the body including inflammation, mood, behavior, pain perception and more.

Delta-8 THC or D8 THC binds to the CB1 receptors which primarily are located within the central nervous system (the brain and the spinal cord). D9 THC also works by targeting and activating the same receptors.

Exploring the Legal Status of Delta 8 THC Alabama

It is important to confirm the legality of D8 THC before purchase. Before we get into the question of is Delta-8 THC legal in the state of Alabama? It is important to understand the intricacies surrounding the cannabinoid’s legality.

We begin by discussing the legality of marijuana and other hemp plants. On the federal level, marijuana is still considered a schedule 1 controlled substance meaning it is illegal to grow, sell or buy on a federal level.

However, multiple states have made marijuana legal for medical and recreational use. What this means is that in certain states it is legal to buy, sell or grow Marijuana, that is within pre-determined limits. In some states, however, it is only legal if you have a marijuana card issued by a licensed healthcare provider.

Federally, hemp is legal in the country, which means it can be produced, sold, and made into products and shipped all across the country seamlessly. And since Delta-8 THC is a hemp extract, it absorbs the federal status of hemp as well.

Of course, each state is free to create their own laws concerning hemp and its derivative products but most times these laws conflict with federal laws and complicates things.
