Is Delta-8 THC Legal In Nevada? Delta 8 Legality by State 2023

Nevada, among the first states to approve the Marijuana Act for Medical Use in 2000, is a significant part of the cannabis industry. In addition, the Farm Bill of 2018 stipulates hemp derivatives with less than 0.3% delta-9 THC content is legal under federal law. On June 4, 2021, Nevada approved Senate Bill-49. By making the following precise amendments, the measure made it illegal for hemp to be a source of delta 8 THC:

  • Extending the THC definition of the state to include delta-8, delta-7, and delta-10 (THC).
  • Changing the definition of hemp to mean any cannabis with Tetrahydrocannabinol concentrations lower than the permitted limit (formerly, and in accordance with federal law, marijuana was classified as cannabis with 0.3% of delta-9 or less).
  • Establishing a new classification for artificial cannabinoids and outlawing their use would be beneficial (even though it is unclear whether delta 8 produced from CBD would fit with this concept).

Final Thoughts

Products containing Delta 8 are illegal in Nevada, and this status is quite likely to stay the same. It is quite doubtful that the situation will change in the near future. Nevada has deliberately created laws outlawing delta-8 as well as other synthetic, hemp-obtained cannabinoids. However, using standard delta-9 products is permitted, given the state’s permissive stance on marijuana for recreational usage.
