Is Delta-8 THC Legal in Massachusetts? D8 Legality By State 2023

Due to the Farm Bill 2018 on the industrial hemp sector, hemp is no longer on the Controlled Substances list. Also, at present, it is legally an essential agricultural item rather than any narcotic. Following this, many states have legalized the hemp-derived substance Delta-8 THC.  Let’s find out if delta-8 THC is legal in the state of Massachusetts!

So, what is the state of Delta 8 THC there in Massachusetts? Though it’s a “YES,” some points still need to be more clear. When smoked or consumed, Delta 8 is a substance that generates similar psychoactive effects as Delta-9 THC. Both kinds of THC bind to receptors in your brain, causing the effects.

The state of Massachusetts followed the federal government’s lead. They explicitly authorized all forms of hemp and its cannabinoids, derivatives, and isomers. That is, except delta 9 tetrahydrocannabinol.

As used in Agricultural Improvement Act 2018, “hemp” refers to the plant species Cannabis sativa L. and all parts of it, along with its seeds, all sorts of cannabinoids, derivatives, cannabinoids, extracts, salts, acids, isomers, and salts of isomers, accommodating delta-9 THC density that doesn’t exceed 0.3 percent based on the dry weight.

A hemp product is any item at or below the federal level of THC. They must be made from hemp plants. Examples of “Hemp Products” include, but are not limited to, personal care products, cosmetics, food meant for human or animal usage, fabric, and more. 

So, commercial hemp is synonymous with hemp in every sense of the terms in Bill H.4001, Section-3. As long as delta-9 THC levels are within the federally legal range, the hemp products are good to go and legal for sale.

As of now, there is currently no statute in effect in Massachusetts that directly addresses Delta 8. Another section 122 of this bill states that hemp-obtained cannabinoids are not adulterants or controlled substances. And, Products containing cannabinoids from hemp are not thought of as restricted narcotics or adulterated goods.

Hemp products that meet the federal legal definition, but that are from another state, are still legal for sale in Massachusetts.

Delta 8 is a legitimate, secure, and effective substitute for marijuana in Massachusetts. It doesn’t need a doctor’s note.
